The employee appealed and his appeal was dismissed."

It goes on to say "In May the employee raised a grievance in which he alleged discrimination on the grounds of race and age against the manager (the grievance). In June the employee was told that the grievance had been dismissed. He then went on sick leave suffering from anxiety and stress. The employee appealed against the grievance decision which was dismissed."

The above-mentioned article further explains that "In December the employee issued a claim form in the employment tribunal alleging discrimination on the grounds of race with respect to the capability meeting and the issue of the final warning. Accordingly the employee’s claims of race discrimination had been presented out of time and it was not just and equitable to extend time."
