Facing Bullying at Work? – We can help



Many employees face problems at work, these could be bullying or harassment or other workplace issues, and sometimes these problems can culminate in making you very unhappy at work.

As employment law experts we strongly agree with the advice from the National Bullying Helpline, when it comes to being bullied. DO NOT RESIGN or at very least DO NOT RESIGN WITHOUT TAKING LEGAL ADVICE.

If you are being bullied at work there are potentially a number of legal avenues which may be available to you such as:

• A claim for ‘Stress at Work’ if the bullying is affecting your mental or physical wellbeing

• A claim under the Protection from Harassment Act 1997

• A claim for Discrimination under the Equality Act 2010 if the bullying is targeted at a ‘Protected Characteristic’

The above claims can be pursued whilst you are still employed.

If you consider that the bullying is so severe so as to amount to a fundamental breach of your employment contract then you may have a claim for Constructive Dismissal if you resign.

The problem is however that not everyone has the right to constructive dismissal so you should check your legal position first.

For instance if you have less than 2 years continuous service then you will be unable to pursue a claim for Constructive Dismissal. There are also a number of other technicalities which can make claims for Constructive Dismissal difficult to pursue.

For this reason it is advisable to seek legal advice at an early stage to discuss the best way to resolve the issues with your employer. There are also less formal ways to try and resolve the issues for instance raising a grievance or seeking mediation.

There are organisations, such as National Bullying Helpline, available to provide support during periods of bullying and stress.
