The recent case of Simmons v Castle Court  EWCA Civ 1288 has confirmed that from 1st April 2013 the level of general damages for personal injury will increase by 10%. This means that any claimant who enters into a conditional fee agreement after 1st April 2013 can look forward to more compensation for their injuries.
The Judicial Studies Board guidelines have now been replaced with the Judicial College Guidelines and have altered how compensation claims are valued. The gender of a claimant is no longer relevant when valuing scarring and whiplash claims are now more dependent on the intensity of the injury rather than the duration of the injury.
