Mrs Childe had worked as a shoe shop assistant for over 30 months. She worked full time and she always had Saturdays off. Her manager was promoted and her new manager wanted more senior staff to work on a weekend to increase sales.

She was unwilling to work on a Saturday; the reason she took the job was to avoid weekend work. She went in to see her manager who insisted that she was to work on a Saturday. The area manager became involved and as her contract stated her hours were during the week she was allowed to continue working her original hours.

This created resentment amongst the other staff and the new manager would not speak to her. She began to be ignored and harassed by the other staff members. Eventually she began to feel shaky and sick before going in to work. On health grounds she had no option than to resign. She put in her letter of resignation that it was due to harassment and victimisation that she was resigning.
