The European Court of Justice recently ruled, in the case of Lock v British Gas Trading Limited, that employees in the UK are in breach of the EU Working Time Directive in respect of how holiday pay is calculated under the Working Time Regulations 1998.
The Employment Appeals Tribunal, in the UK, ruled that overtime and commission payments should to be taken into account when calculating holiday pay. The law in this area is complex, and is continuing to develop. Given the wider public policy issues that could flow from this decision, it is likely that there will be an appeal in the Court of Appeal.
Michael Lewin Solicitors are experts in No Win, No Fee employment claims, and can advise you through the legal issues surrounding claims for unpaid commission or overtime following the decision of the Employment Appeals Tribunal.
There are strict time limits for making claims in the Employment Tribunal and there remains some uncertainty over what period, if any, back pay can be claimed; however, we are aware that many employers will be open to negotiating settlement at this stage rather than await the outcome of any further appeal, which may take years to resolve.
In order to make a claim you must satisfy the following criteria:
- You should be an employee or a worker (i.e. NOT self-employed);
- You should be contractually entitled to overtime and/or commission payments;
- You should be able to quantify, over a consistent period, the typical amount of overtime and/or commission paid in any given time period.
- If you are paid overtime, shift allowances, or unsociable hours payments, then you may have a claim.
No Win No Fee
If you wish to make a claim regarding unpaid holiday pay, Michael Lewin Solicitors could help you with this on a No Win, No Fee basis. This means that there is no financial risk to you, even if you lose the claim.
Michael Lewin Solicitors are experts in dealing with compensation claims arising out employment disputes. We usually offer a ‘No Win, No Fee Agreement’ (sometimes called a Damages-based Agreement). In addition, we can provide insurance to cover the cost of Employment Tribunal fees in the event that you are not successful, and other such risks.
