The European Court of Justice recently ruled, in the case of Lock v British Gas Trading Limited, that employees in the UK are in breach of the EU Working Time Directive in respect of how holiday pay is calculated under the Working Time Regulations 1998.

The Employment Appeals Tribunal, in the UK, ruled that overtime and commission payments should to be taken into account when calculating holiday pay. The law in this area is complex, and is continuing to develop. Given the wider public policy issues that could flow from this decision, it is likely that there will be an appeal in the Court of Appeal.
