Solicitors have various obligations under the Code of Conduct to provide clients with information and updates in respect of legal costs. If the Solicitor fails to provide appropriate advice then the firm may be in breach of their professional obligations and also in breach of contract.

Outcome 1.6 of the Code of Conduct provides that Solicitors must only enter into a fee arrangement which is in the clients best interests.

Outcome 1.13 provides that Solicitors must provide information about the likely cost of the instruction and Outcome 1.15 provides that Solicitors must properly account to clients regarding the financial benefit of their instructions.

Solicitors must also consider all appropriate forms of funding even if the firm themselves do not offer that type of funding. This will include considering:

civil litigation
  • Private retainer;
  • No Win No Fee Agreements
  • Damages Based Agreement
  • Trade Union cover
  • Legal Expenses Cover
  • After the Event Insurance
  • Fixed Fee

If a firm of Solicitors is acting on a No Win No Fee Agreement then they are under an obligation to advise clients about the amount of the success fee and there are legal restrictions on the extent of any deductions from damages.

Further Solicitors are obliged to advise clients about the possibility of insuring any legal action.

If you have therefore paid more for legal services than you expected or if you have had monies deducted from damages without your knowledge or consent then you may be entitled to recall those sums from the Solicitors.
