We expect that the products we purchase should be safe and fit for the purpose intended, unfortunately this is not always the case.

Product liability covers a vast area of law including all dangerous or faulty goods. We aim to get our clients the compensation they deserve, if they have been injured by dangerous products or faulty goods. Product manufacturers are liable for our safety when designing and building their goods and must make stringent checks to ensure they do not become dangerous products.  This includes any product from child toys, to cleaning products, mobile phones, foods and even medication.  Effectively it’s any product available to the public.

The law holds manufacturers, suppliers, distributors and retailers responsible for dangerous and faulty products that cause injury through an inherent defect or those that are just not fit for purpose.

Many dangerous or faulty products are recalled everyday as defects are discovered within those products which are deemed unsafe for the public.  Some of these products you may see in the headlines.  However, the majority do not make it that far and injury may be caused before the product is withdrawn.

When looking at whether a product is faulty or dangerous it’s not always about the product breaking, such as a child’s toy or bicycle wheel falling off,  it may be that the product is just not fit for the purpose it was designed, for example, a sun cream which does not protect against suns rays.  Clearly a dangerous product such as this has not been designed or manufactured to a standard whereby it is fit for the purpose it was intended.

When injury is sustained as a result of a defective product it can be difficult to know if you can claim, how you can claim and where to start.

Here at Michael Lewin Solicitors we have extensive experience in dealing with such claims.  We can quickly assess if you have grounds for a claim and then get things underway.  Not only do we deal with the issue of the law in respect of liability but we assess your injury and rehabilitation needs in order that nothing is missed.  Further to this we ensure the best client care is provided at all times.  Our dedicated product liability team will endeavour to resolve your claim in the most efficient way possible.

What is a Faulty Product claim?

The Consumer Rights Act dictates that all products must be of satisfactory quality, fit for purpose and as described.

Satisfactory qualityGoods shouldn’t be faulty or damaged when you receive them. You should ask what a reasonable person would consider satisfactory for the goods in question?

Fit for purpose – The goods should be fit for the purpose they are supplied for, as well as any specific purpose you made known to the retailer before you agreed to buy the goods.

As described – The goods supplied must match any description given to you, or any models or samples shown to you at the time of purchase.

The Consumer Protect Act 1987 provide the provisions and protection for consumers to use a product in the knowledge that the product is safe and fit for purpose.  The Act sets out who is liable for a faulty product.  We at Michael Lewin Solicitors are here to help you win your case against any manufacture or persons deemed at the producer who has sold you a faulty product and has caused injury or property damage.
