Woman With PIPs Implants Allowed Leave to Apply for Judgement Against Surgery Group
Samantha Gibbs who has defective PIP breast implants has been given leave in order to apply for judgement against Dublin-based Harley Medical Group Limited.
Ms Gibbs from Ballintubber and hundreds of other women have sued the Dublin Harley Group who are now in liquidation for breach of contract in the surgical insertion of Poly Implant Prothese (PIP) manufactured implants.
Ms Gibbs stated to the Circuit Civil court that in 2007 she had learnt that the implants could be defective and could potentially leak industrial grade silicone into her body.
She is now perusing a damages claim for €38000 against the Harley Group and Judge Jacqueline was told that because the company is in liquidation Ms Gibbs is required to re-enter proceedings and seek judgement in default of appearance.
Over six years ago the news was released that PIP implants manufactured by the French company Poly Implant Prothese were created with industrial grade silicone which could be toxic and leak into the body.
Judge Lianne has confirmed that Ms Gibbs’ new application on notification of the court appointed liquidator would go ahead on October 29th.
